PiknPark – Terms & Conditions

1. Definitions

“Company” / “PiknPark” refers to Gistic OY (Business ID: [insert]), operating under the name PiknPark.

“Customer” means any private individual or company booking services through PiknPark.

“Driver” means any independent contractor performing driving or vehicle transfer services on behalf of PiknPark.
-
“Service” refers to airport/station vehicle transfers, chauffeur services, and car care logistics.
-
“Platform” refers to PiknPark’s website, customer portal, and driver portal.
2. Eligibility
Customers

Must be at least 18 years old and legally entitled to enter into service agreements.
-
Must own or have legitimate authority to use the vehicle being serviced.
Drivers
-
Must hold a valid Finnish B-class driving license.
-
Must be legally eligible to work as self-employed or operate under a Finnish business structure (e.g., toiminimi, Oy, or invoicing platforms like UKKO.ee or OP Kevytyrittäjä).

Must pass PiknPark’s onboarding verification process (ID, license, criminal record extract if required, etc.).
3. Nature of the Service
PiknPark:

Does not provide transportation of persons.
-
Only arranges vehicle transfers and chauffeur driving using the customer’s own vehicle.

Operates as an intermediary platform between Customers and Drivers.
4. Service Process
By booking a service, the Customer:

Provides vehicle handover location and schedule.
-
Declares the vehicle is legally roadworthy, insured, taxed, and inspected.

Authorizes PiknPark and its Drivers to operate the vehicle for the agreed purpose.

Agrees that PiknPark may use third-party subcontractors (Drivers).
5. Customer Obligations
Customers must ensure:

The vehicle has valid Finnish traffic insurance (liikennevakuutus).
-
The vehicle has valid inspection (katsastus) and roadworthiness.
-
No illegal substances, weapons, or hazardous materials are present in the vehicle.
-
The fuel level or battery charge is adequate for the planned trip.
If a vehicle is non-compliant at pick-up, PiknPark may cancel the service and charge a cancellation fee.
6. Driver Obligations
Drivers agree to:

Operate vehicles safely, legally, and professionally.

Not operate vehicles under the influence of alcohol, drugs, or impairing medication.

Comply with Finnish traffic laws.

Notify PiknPark immediately of any incidents, fines, or damages.
Drivers act as independent contractors, not employees. PiknPark does not pay holiday pay, pension, unemployment insurance, or YEL contributions. Drivers are responsible for their own taxation and social insurances.
7. Insurance & Liability
Customer Vehicle Insurance
Driving is covered by the Customer’s mandatory traffic insurance (liikennevakuutus) as required by Finnish law.
Damage Liability

Damages caused during service are primarily handled through the Customer’s comprehensive insurance (kasko), if applicable.

Any deductible fees or uncovered damages may be charged to the responsible party.
PiknPark Liability
PiknPark is liable only for:

Damages caused by intentional misconduct or gross negligence.
-
Operational failures directly attributable to PiknPark’s platform.
PiknPark is not liable for:
-
Pre-existing damages.
-
Mechanical failures unrelated to driving.
-
Delays caused by traffic, weather, or force majeure.
-
Indirect or consequential losses (missed flights, hotel fees, etc.).
8. Cancellation & Refund Policy
Customer Cancellations

Cancellations 24+ hours before scheduled time: Free.
-
Cancellations within 24 hours: 50% charge.
-
No-show at pickup: 100% charge.
Company Cancellations
PiknPark may cancel due to:

Unsafe vehicle condition
-
Invalid documentation
-
Force majeure
Customer receives a full refund in such cases.
9. Payments

Payments are processed via secure third-party processors (e.g. Stripe, Paytrail).

Service fees and pricing are visible before confirming booking.
-
Invoices for companies are available upon request.
Drivers are paid bi-weekly or monthly depending on contract terms.
10. Data Protection & GDPR Compliance
PiknPark processes data according to the EU General Data Protection Regulation (GDPR).
Collected data includes:

Customer contact information

Vehicle information
-
Booking details
-
Location data for operational purposes
-
Driver documentation for verification
Data is never sold to third parties.
Full privacy policy available separately.
11. Prohibited Use
Users may not:

Misuse the platform for illegal activity

Provide false documents
-
Request Drivers to violate traffic laws

Transport illegal items in vehicles
12. Dispute Resolution
Disputes are first handled via PiknPark customer support.
If unresolved:

Consumer disputes may be escalated to Kuluttajariitalautakunta (Finnish Consumer Disputes Board)

Jurisdiction: Helsinki District Court

Applicable law: Finnish law
13. Amendments
PiknPark may update Terms & Conditions.
Users will be notified when material changes occur.
